User agreement

1. use of the learning platform
The learning platform is operated by Lehrke Verlag GmbH. The content of the learning platform is available to users in accordance with the administration and basically free of charge.

The right of use expires automatically upon leaving the member institution or upon termination of a project partnership, unless a special status (e.g. as alumni) has been pronounced.

2. copyrights
All copyrights to the content remain with the respective authors.

Any reproduction (data carriers, printouts and copies on paper or other materials, etc.) and/or their transfer to third parties for commercial purposes during and after termination of the access authorisation is not permitted and will be prosecuted under criminal and civil law. It will also lead to immediate termination of the user authorisation. This also applies to making the content accessible to third parties who are not authorised to access it (e.g. by passing on the personal password).

3. data protection
3.1 Data collected, processed and stored
A valid e-mail address is required for registration on the platform. Furthermore, the first and last name as well as the user name and the institution are mandatory. The institution is required for the assignment to the member institutions within the BAG digitale Lehre HöD. This personal data is only stored to enable users to access the content and only for the duration of use.

Data on user behaviour on the learning platform is recorded by the system and can be viewed by administrators or authors. The following data is recorded and stored:


Consent to use agreement and date of consent
The permissions or roles of each user name
For membership in groups and courses: date of enrolment and learning progress ("Not yet started" / "In progress" / "Worked on" / "Failed")
History data: Date of account creation and by whom (owner), last login and ownership of objects.
When using the internal mail system, the messages sent and received via this e-mail function
When using the automated notification function in groups and courses, the messages sent and received in each case.
In the event of an error and for quality assurance purposes, server logs can be activated and evaluated by the administrators. These contain the name of the retrieved file or page, date and time of retrieval, amount of data transferred, http status code, retrieving IP address and browser type and version.
Support problems and requests are forwarded to a support system at the provider if necessary. In addition to the personal data (surname, first name and e-mail address), the date and time of the support ticket creation, the content of the ticket and its processing history, as well as the course of further communication regarding this ticket until the ticket is closed (completion of the request) are stored there as history data.
The data may be viewed by the following persons for the purpose of fulfilling the purpose:


Course tutors, group and/or course administrators can see the enrolled participants and their learning progress with master and history data (enrolment status, list of participants, learning success, last login/registration).
Group and/or course members see the user names of the respective members and can contact them. Further details (so-called profile data) are only visible if they have been released by the respective user.
During use, all participants can see who is on the learning platform at the same time ("Active users" - display). the users themselves determine data beyond the publication of the name and user name in the personal profile.

3.2 Data storage
The data is stored by a provider in the form of commissioned data processing. A contract in accordance with the provisions of the German Data Protection Regulation (DSGVO) is available.

3.3 Disclosure of data to third parties
No data is passed on to third parties.

3.4 Data portability

3.5 Data deletion
As soon as the users inform the local administrator of their institution in writing or by e-mail that they are no longer interested in further use, their data will be deleted. However, any personal details within comments and forums remain unaffected by this, as this cannot be automated. Therefore, entries should be considered as such.

3.6 Anonymised data storage
The users also agree that the data may be stored beyond the period of use if this is done in an exclusively anonymous form and the information is only used for scientific purposes, e.g. for optimising teaching, compiling user statistics, etc. The data may also be used for other purposes.

3.7 Notes on cookies
The learning platform is accessed via a browser. In this context, two cookies are written when calling up current learning platform versions. The cookies are stored on the client (user's browser) and not in the learning platform itself or on the servers of the learning platform provider. No personal data is written directly to cookies.

4. obligations of the users
Users may not publish any offensive or unlawful statements and content in their contributions (forums, chats, targets of hyperlinks as well as uploaded files, etc.). Violations of these provisions may be prosecuted under criminal and civil law and may lead to the immediate termination of the user's authorisation.

Users are obliged, to the best of their knowledge and belief, to refrain from actions and data entries on the learning platform that could lead to a disruption of the overall operation.

5. disclaimer
No responsibility is accepted for content referred to directly or indirectly (links) and which lie outside the sphere of influence of Lehrke Verlag GmbH.

No guarantee is given for the topicality and completeness of the content provided on the learning platform. Liability claims against the authors, the Lehrke Verlag GmbH and the operators of the learning platform relating to material or non-material damage caused by the use or non-use of the content provided or by the use of incorrect and incomplete content are excluded. The use is at the user's own risk.

6. miscellaneous
This user agreement is accessible online from the registration page. It may be amended by Lehrke Verlag GmbH at any time, provided that this is objectively justified.

By agreeing to this user agreement, the user acknowledges the validity of each individual provision for him or herself; the validity of each individual provision is not affected by the validity of other individual provisions. Changes come into force with the online publication. By continuing to use the learning platform, users agree to the amended agreement.
