CAFEA, DEK-B, DEK-HH: Nutzungsvereinbarung

Preamble

CAFEA GmbH, Am Sandtorkai 2, 20457 Hamburg (hereinafter "CAFEA", "we", "us") operates the visitor management of the Cafea - Group. Within the scope of these activities, CAFEA processes personal data on behalf of and for the purposes of the companies of the Cafea - Group, which is why CAFEA qualifies in this respect as a data protection law processor within the meaning of Art 4 Z 8 of the General Data Protection Regulation (DSGVO). CAFEA is to be qualified as a controller within the meaning of Art 4 No. 7 of the GDPR if personal data are processed for its own purposes. For CAFEA, the protection and confidentiality of your data is of particular importance. It goes without saying that your data will be processed exclusively in accordance with the applicable data protection regulations, in particular the German Federal Data Protection Act (BDSG) and the German Telemedia Act (TMG). This data protection declaration also complies with all legal requirements that will become mandatory when the European Data Protection Regulation (DSGVO) comes into force. The DSGVO has been in force since 25 May 2018.

What is personal data?
Personal data is any information from which conclusions can be drawn about your personal or factual circumstances or which makes you identifiable.

Company name and address
First and last name of the visitor
Reason for the visit
If required: Info on hygiene instruction and a corresponding validity date
Date and time of the start and end of the visit
If you drive onto the premises with a vehicle; the vehicle registration number

3. purpose of the data collection
CAFEA uses your personal data exclusively to comply with the documentation of visitor traffic within the framework of the requirements of product protection, the status as AEO and the requirements of the employers' liability insurance association.

4. is data passed on to or collected from third parties?
Data collected by CAFEA will neither be published by CAFEA nor passed on to third parties without authorisation, i.e. in particular without your consent.
CAFEA may be legally obliged to release data if the release of the data is necessary for the assertion, exercise or defence of legal claims of the principal before a public authority.
To the extent that CAFEA wishes to use your data in a way that goes beyond what is described above, CAFEA will obtain your express consent in advance.

5. storage periods
Within the framework of the above-mentioned requirements, we have set a retention period for visitor data, tickets and vehicle passes of 5 years after the end of the calendar year.
Longer storage periods than those mentioned may also result from the fact that the data is necessary for the assertion, exercise or defence of legal claims before an authority or that there are statutory retention obligations. The data will be stored for as long as is necessary to fulfil these purposes.

5. your rights regarding stored data
You have the right to obtain free information about which of your personal data we process, as well as the right to rectification, erasure, restriction of data processing and data portability. 6. revocation possibility

7 Validity of the agreement (severability clause)
The unlawfulness, ineffectiveness, invalidity or unenforceability of parts of these data protection provisions and terms of use shall not affect the effectiveness and validity of the remaining provisions.

8. complaint to the data protection authority
If you believe that we are processing your data in breach of applicable legislation, you can lodge a complaint with the competent supervisory authority.
